Full-time po sition which performs a wide variety of routine to complex criminal prosecution in the State and Federal court systems including misdemeanor and felony criminal violations and youth court matters; does related duties as required. elements. Synthesizes legal materials and composes written briefs, pleadings and other documents. Exercises virtu ally complete discretion in determining the propriety of plea agreements and in negotiating such agreements to resolve complex felony cases prior to trial. Exercises virtually complete discretion in the prosecution of complex felony mat ters nearly all of which are tried before district court juries. Presents evidence, examines witnesses, argues objections and motions, and presents arguments to the court and juries. Prepares and sub mits jury instructions. Decides whether to appeal adverse lower court decisions, if allowed by Montana Law, or to initiate other legal proceedings based on analy sis of applicable legal provisions and precedent, perceived chance of success, cost to the state, and alternatives to litiga tion. Analyzes resulting decisions for legal effect and impact on the interests of the State. Prepares and argues appeals in the Montana Supreme Court from cases tried by the lawyer in the lower court. Researches and prepares written briefs and presents oral arguments to Montana Supreme Court as needed. Serves as lead attorney on cases that are tried and supervise the investigative efforts of local law enforcement officers and Montana Division of Criminal Investigation in the preparation of cases for trial. DEPUTY PROSECUTOR: The Nez Perce County Prosecutor’s Office is ac cepting applications for two full-time Deputy Prosecutor positions commenc ing employment October 1, 2024. These positions are located in Lewiston, ID, at the base of the Hells Canyon and the confluence of the Snake and Clearwater Rivers in the Lewis-Clark Valley. DEPUTY COUNTY ATTORNEY (CRIMINAL): The Deputy County Attorney (Criminal) in Cascade County prosecutes adult criminal offenders through final disposition in Justice and District Courts, may also prosecute child abuse and neglect cases, bring involuntary mental health commitments, prosecute child support enforcement, initiate guard ianship/conservatorship proceedings, prosecute youth offenders in Youth Court and attend Drug Treatment Court, reviews investigative reports from law enforcement officers, makes determination regarding charges to be filed, whom to prosecute and when to decline prosecution, drafts and files charging documents, coordinates, plans, prepares and executes jury and judge trials, communicates regularly with victims and law enforcement regarding case status, prepares for and attends vari ous court hearings such as arraignments, omnibus, bail, suppression, change of plea, sentencing, revocation, etc., interviews and prepares witnesses for courtroom proceedings, prepares pleadings, briefs and other legal documents for filing with the court, responds to various written and oral motions and arguments made by defense counsel, prepares jury instructions and necessary trial and/or hearing exhibits, must be able to communicate well with witnesses and victims of all ages, social, economic and educational backgrounds, negotiates plea agreements, assists law en forcement with and drafts search warrants and subpoenas, conducts legal research and prepares legal briefs, memoranda and other documents, provides legal advice to various County officials, outside agencies and law enforcement, drafts legal opinions, researches and interprets statutes, codes and ordinances, negotiates with concerned parties to resolve contested issues, prepares findings of fact and conclusions of law and drafts proposed orders, prepares argu ments orally and in writing, must serve
