public – “to bring us into the light” – and to bring access to justice to those who need it. With regard to access to the Illinois Supreme Court, she wants ordinary people – non-legal professionals – to have a better idea understanding of the roles and responsibilities of the courts. “The public is very uninformed of our duties. The judiciary is the third branch of govern ment, and we are the most misunderstood and mysterious branch of government.” Education is one means of accomplishing the goal, and Justice Cunningham views the bar associations as a valuable resource to accomplish this task. “Bar associations are the lifeblood of the legal profession... bar associations, especially The Chicago Bar Association, have a broad reach across the legal community. Bar associations can connect members and the community
at large.” For example, programs like the Early Resolution Program which is offered in eviction and certain non-jury civil cases, have come about in large because of The Chicago Bar Foundation’s efforts and per sistence. Bar associations play a vital role in educating the public about this third branch of government. Cunningham identifies access to jus tice as another significant concern for her and the Court. Many factors includ ing diversity and economic underpin access to justice. A growing population of people cannot afford lawyers. People are not resolving their own disputes; there is not less litigation. People still have issues but simply may have no way of retaining an attorney. She encourages more use of alternative dispute resolution forums in certain cases such as consumer matters. “ADR is a means of leveling the playing
field for many now who cannot access justice simply because they cannot afford it.” She notes, “there is more than one way to skin a cat. We have to be creative.” Creative solutions include continuing to use Zoom in cases where appropriate. Cunningham applauds her immediate predecessor’s – Chief Justice Anne Burke’s – leadership during the pandemic and her ability to pivot to virtual court. Cunning ham advocates continuing to utilize tech nology, especially in more rural counties. Always an optimist, Cunningham has continually sought out opportunities and has never shied away from a challenge. She is humbled and honored to be Chief Justice Burke’s successor and is looking forward to an important tenure.
