that “the person requesting the records shall reimburse the attorney for all reasonable expenses . . . incurred by the attorney . . .” and providing guidelines and maximum amounts that the attorney may charge. The ABA Opinion recommends that attorneys “explain in their retainer letters who is responsible for the costs of copying and under what circumstances,” includ- ing who should pay for time and cost of duplication of materials upon termination of the representation. In Illinois, however, attorneys should be mindful of the costs allowable under the Illinois Code.

Applicability The ISBA and ABA Opinions both assume that the lawyer has been paid in full and do not address retaining liens. Similarly, the Illinois Code “applies only if a client and his or her authorized attorney have complied with all applicable legal require- ments regarding examination and copying of client files, including but not limited to satisfaction of expenses and attorney retaining liens.”
