the attorney-client privilege if a non-lawyer has access to the virtual meeting. You should become familiar with the governing agree- ment with your service provider before using the service. Perhaps the most all-encompassing issue is one that this column has raised before – the requirement under the comments to Rule 1.1 that a lawyer keep abreast of the “benefits and risks associated with relevant technology.” Since the comment was writ- ten, technology has become even more central to a lawyer’s work. It is hard enough to address issues such as hacking of sensitive information or encryption of emails when working from an office where technical sup- port is available. It is even more difficult to do so when working from home. But it is a task that must be done in an ever-more- technological world. As a footnote, one of the pitfalls raised in the ABA Journal article was how nega- tive personal events may adversely affect professional life. The stresses imposed by the pandemic cannot help but impact pro- fessional work. Try to keep in balance and have a sense of humor.

More on the Pandemic O ver the past several years, publica- tions in the field of legal ethics and professional responsibility have focused greater and greater attention on the impact of technology on the practice of law. Many of these columns have addressed this subject. Most of these discussions treat technology as an aid to – ancillary to – the practice.The current pandemic has changed this focus. To a large extent, technology has become central to the practice of law.

However, heavy reliance on the internet for contact with potential clients carries two major risks.The first is working outside of your jurisdiction and engaging in the unauthorized practice of law. The second is unintentionally creat- ing an attorney-client relationship through an idle communication. These risks can be avoided by appropriate disclaimers in websites and emails, and by always paying attention to with whom you are commu- nicating. The ABA Journal article also refers to the threat to client confidentiality through data mining by service providers who glean information from your searches and stored material.This risk has been greatly increased by the almost universal use of teleconferenc- ing services in lieu of face-to-face meetings.
